General Terms and Conditions
1.
1.1 These general terms and conditions ("Terms") apply when you as a consumer ("Customer") place an order via www.butikel.se and related pages ("the Website"). An agreement is entered into between you and Butik EL I Sverige AB, organization number 559100-8668. Detailed contact information and other information about Butik El can be found on the Website. The Terms are only applicable to Customers who are consumers and who place orders via the Website.
1.3 To be able to order on the Website, the Customer must be 18 years old. Butik El does not accept credit purchases for persons under 18 years of age, in accordance with Swedish law. Butik El reserves the right to refuse or change a Customer's order in individual cases (for example, if the Customer has provided incorrect personal data and/or has a poor payment history).
1.4 Butik El reserves the right for stock depletion and any image and typographical errors on the Website, such as errors in product descriptions or technical specifications, incorrect prices, price adjustments (such as changed prices from suppliers, currency fluctuations), or incorrect information regarding product availability. Butik El has the right to correct any such errors and to change or update information at any time. If an incorrect price has been stated for an item ordered by the Customer, Butik El will, of course, notify the Customer of this and await the Customer's approval of the corrected price before Butik El proceeds with the order. All image information on the Website should be seen exclusively as illustrations. Such illustrations cannot be guaranteed to accurately reflect the number of items the Customer receives or the item's exact appearance, functions, or origin. Butik El is not responsible for information on the Website originating from a third party.
1.5 The Website, and all content on it, is owned by Butik El or its licensors. The information is protected by, among other things, intellectual property and marketing law. This means that trademarks, company names, product names, images and graphics, design, layout, as well as information about goods, services, and other content may not be copied or used without written approval from Butik El.
2. Agreement and Order
2.1 To make a purchase via the Website, the Customer must accept the Terms. By accepting the Terms, the Customer agrees to abide by the Terms in their entirety, and acknowledges that they have read the information about personal data and consented to the use of personal data and cookies in accordance with Butik El's Privacy Policy.
2.2 An agreement of purchase is only entered into when Butik El has confirmed the Customer's order and the Customer has received an order confirmation from Butik El via e-mail. Butik El urges the Customer to save this order confirmation for any contact with Butik El's customer service. The Customer can revoke their order until it has been confirmed by Butik El. If the order is revoked, Butik El will refund any payments made by the Customer or their payment or credit card company regarding the order.
3. Customer Information, etc.
3.1 Butik El recommends that the Customer create a user account before shopping on the Website. When the Customer registers their user account and/or makes an order, the Customer will be asked to provide certain personal data. The Customer confirms that the information they provide is correct and complete and is responsible for incorrectly entered information. Information about Butik El's processing of personal data can be found in Butik El's Privacy Policy, which is part of these Terms.
3.2 The Customer undertakes to ensure that no one other than the Customer can use the Customer's login details. The Customer may not disclose username and password to any unauthorized person and must ensure that documents containing username and password are stored in such a way that unauthorized persons cannot access the information. The Customer must immediately report to Butik El if it is suspected that an unauthorized person has gained access to the Customer's password. The Customer is responsible for all purchases made with their login details if such a report has not been made.
3.3 If Butik El suspects that the Customer is misusing their user account or login details or otherwise violating the Terms, Butik El has the right to suspend the Customer. Butik El also has the right to assign new login details to the Customer.
4. Prices, fees and payment
4.1 For orders placed via the Website, the prices stated on the Website apply. Prices are stated in Swedish Kronor and include VAT. Prices do not include payment and shipping fees, which are stated separately.
4.2 The Customer can pay in the ways specified on the Website. Read more about our payment methods and discounts in the Website's Payment Terms. Butik El has the right to charge the Customer already at the time of ordering, unless invoice payment or another similar payment method has been chosen by the Customer and approved by Butik El. In case of invoice payment or partial payment, Butik El or its partners may carry out a credit check. You will be informed of this if it occurs. Butik El reserves the right not to always offer all payment methods, or to change payment methods if the one chosen by the Customer does not work for any reason at the time of purchase. Please note that any limitations on payment options are stated on the Website.
5. Campaigns and offers
Butik El may from time to time offer campaigns on the Website which may have more favorable terms than those set out in these Terms, e.g., regarding payment or extended right of withdrawal. These more favorable terms apply as long as the campaign is active and for the specific goods specified by Butik El in connection with the campaign. Butik El reserves the right to withdraw such campaigns at any time. Upon termination or withdrawal of a campaign, these Terms apply without changes. Offers on specific goods on the Website apply for a limited period and while stocks last.
6. Delivery and transport
6.1 Goods in stock are delivered within the number of working days specified by you on the Website, a minimum of 3 working days. Unless otherwise specifically agreed (e.g., in connection with booking goods not in stock), delivery will take place no later than 30 working days from the date Butik El has confirmed the order in writing via the order confirmation. More information about Butik El's delivery of goods and delivery terms can be found under Delivery Terms.
6.2 The estimated delivery time for the item is 3 working days from the order confirmation. In the event of a delivery delay, Butik El will notify you and continue to monitor the order. Unless otherwise specifically agreed and a delivery takes more than 30 working days and this is not due to you as the Customer, you have the right to cancel the purchase.
7. Right of withdrawal
7.1 When purchasing goods on the Website, a 14-day right of withdrawal always applies in accordance with current consumer protection legislation. This means that the Customer has the right to cancel their purchase by notifying Butik El within 14 days from the date the Customer or the Customer's representative received the ordered item (the withdrawal period).
7.2 The right of withdrawal does not apply to the following types of goods
goods with broken seals;
goods that have been manufactured according to the customer's instructions or that have otherwise been given a clear personal character; (e.g., cable purchased by the meter.)
7.3 By accepting the Terms, the Customer agrees that the right of withdrawal does not apply to digital content delivered other than on a physical medium.
7.4 In connection with an order for goods for which the right of withdrawal does not apply, the Customer receives clear information about this. If an item has been sealed, the Customer may not break the seal if they wish to exercise their right of withdrawal. The right to cancel therefore ceases when the Customer breaks the seal. Seal also refers to technical seals (e.g., serial numbers).
7.5 If the Customer wishes to cancel the purchase, the Customer must, before the withdrawal period expires, send a clear and unambiguous message to Butik El in the manner specified under Right of Withdrawal, Return & Exchange. The Customer must state their name, address, and other relevant information, e.g., order number, invoice number, and name of the item in the message. If the Customer does not wish to use the above message options, the Customer can use the standard form for exercising the right of withdrawal provided by the Swedish Consumer Agency (see www.konsumentverket.se).
7.6 When exercising the right of withdrawal, the Customer pays the return shipping and is responsible for the condition of the goods after the Customer has received them and during the return shipping. The goods must be returned within 14 days from the date the notification of exercising the right of withdrawal was given to Butik El. The goods must be sent back well packaged, in good condition and in their original box. Returns must be made to Butik El according to the methods and instructions specified on the Website, which you can find under Right of Withdrawal, Return & Exchange.
7.7 Sometimes Butik El may offer free returns for certain goods. If free return applies, it will be stated on the relevant product page on the Website.

7.8 Refund conditions for cancelled purchases

When the Customer exercises their right of withdrawal, Butik El refunds the amount paid by the Customer for the item, including the standard delivery cost.

If the Customer has chosen a more expensive delivery method than Butik El's standard option, only the cost corresponding to standard delivery will be reimbursed. In the event of a partial return of an order, the delivery cost will not be refunded.

Butik El has the right to deduct from the refund amount an amount corresponding to any depreciation in the value of the goods, if such depreciation is due to the Customer having handled the goods to a greater extent than necessary to determine their characteristics and function.

7.9 Refund upon exercising right of withdrawal

Butik El will refund the amount paid as soon as possible, however, no later than fourteen (14) days from the day Butik El received the Customer's notification that the right of withdrawal is being exercised.

Butik El reserves the right to withhold the refund until the item has been returned or until the Customer has demonstrated that the item has been sent back, for example by presenting a submission receipt from the carrier.

Refunds will be made via the same payment method used for the purchase, unless otherwise specifically agreed or there are obstacles to such a refund.

8. Products

8.1 Product quality and approval

All products sold via www.butikel.se are intended for and approved for use in Sweden, in accordance with applicable regulations and standards. Butik El strives to offer high-quality products and exclusively sells items sourced from professional suppliers and the established professional market.

Please note that information about product certifications, technical specifications, and areas of use is provided in the respective product description. The customer is responsible for ensuring that the product is suitable for its intended purpose.

9. Warranty and complaint

9.1 Warranty

Some of Butik El's goods may be covered by a warranty. Information about the warranty period and any special conditions for each product is stated on the Website, in the product description or in these Terms.

The warranty only covers original manufacturing defects and does not include:

  • Damage caused by improper use or external impact

  • Wear and tear, accidents or lack of maintenance

  • Defects arising after interference with the product's function, construction or appearance, such as modification, upgrade, installation of third-party components or other customization that deviates from the manufacturer's recommendations

The warranty applies only to the original purchaser and is not transferable. To claim warranty, the Customer must be able to present valid proof of purchase, normally in the form of an order confirmation or receipt.

If a product is covered by warranty and a valid defect is found within the warranty period, the Customer has the right to remedy in the form of repair, redelivery or other reasonable measure, depending on the nature and extent of the defect. Butik El determines the appropriate measure.

9.2 Right of complaint

 

The right to complain covers goods that are faulty according to current consumer protection legislation, primarily the Consumer Sales Act. If the Customer discovers a defect in an item, Butik El must be contacted as soon as possible after the defect has been discovered, using the contact details provided on the Website.

Complaints made within two (2) months from the date the defect was discovered are always considered to have been submitted in good time. The Customer has the right to complain about an item for up to two (2) years from the date of purchase. For a complaint to be approved, the defect must be original, meaning it must have existed at the time of delivery.

Burden of proof after six months

After six (6) months from the purchase, it is the Customer's responsibility to show that the defect existed at the time of delivery (so-called burden of proof according to the Consumer Sales Act).

Applies only to consumer purchases

The right to complain under this point applies only to consumers. For corporate customers (traders), the Sales Act applies, where the right to complain, liability, and rights may differ from consumer rules.

Handling of complaints

In the event of an approved complaint, Butik El primarily offers free repair or redelivery. If this is not possible within a reasonable time, the Customer is entitled to a price reduction or refund, depending on the nature and extent of the defect.

Processing time

Butik El undertakes to process complaint cases expeditiously. Our goal is to provide a first response within five (5) working days after receiving the complaint.

9.3 Return shipping for complaints

 

In the event of a complaint, the Customer is initially responsible for the return shipping cost.

If the complaint is approved by Butik El, the Customer will be reimbursed for reasonable shipping costs upon presentation of a receipt.

Alternatively, Butik El can provide a return shipping label after contacting Customer Service. No compensation is given for return shipping if the complaint is not approved.

9.4 In the event of a complaint, a complaint form must be filled out and approved by Butik El AB before a return label is sent. Butik El reserves the right to refuse a complaint if it turns out that the item is not faulty according to applicable consumer protection legislation. For complaints, Butik El follows the guidelines of the National Board for Consumer Disputes. More information can be found at www.konsumentverket.se.
Warranties only cover product warranty against manufacturing defects from the respective manufacturer.
Costs related to any work for connection, disconnection, downtime, or similar are not covered by the warranty.
Warranties on products that must be installed by an electrician expire if a receipt or invoice copy for the installation cannot be shown upon request. You can find the complaint form here
10. Links
10.1 Butik El may link to other websites that are outside Butik El's control, and websites outside Butik El's control may link to the Website. Although Butik El tries to ensure that Butik El only links to websites that share Butik El's privacy and security regulations according to the Privacy Policy, Butik El is not responsible for the protection or privacy of information or personal data that the Customer provides on other websites. The Customer should exercise caution and read the privacy regulations for the relevant website.
11. Force Majeure
11.1

 

Butik El is not responsible for delays, non-delivery, or the need for price adjustment due to circumstances beyond our control that we could not reasonably foresee or influence. Such circumstances include, but are not limited to:

  • Labor disputes (e.g., strike or lockout)

  • War, war-like conditions, sabotage, or terrorist attacks

  • Natural disasters such as storms, fires, floods, or lightning strikes

  • Pandemic, epidemic, government measures, or import/export restrictions

  • Shortage of materials, components, or raw materials

  • Unexpected price increases from manufacturers or suppliers

  • Changes in exchange rates, customs duties, or transport costs that significantly affect our cost structure

  • Technical problems such as system failure or disruptions in electricity, telecommunications, or data networks

  • Delays or failures from subcontractors caused by similar circumstances

Such events constitute grounds for exemption, which means that Butik El is free from obligations to fulfill agreements according to the original plan. This means that we are not liable for damages, penalties, or other financial claims arising from these events.

If the aforementioned situation were to affect our ability to deliver at the stated price or within the stated time, Butik El reserves the right to adjust prices, change delivery times, or – in extreme cases – cancel the agreement entirely or partially. We undertake to promptly inform the Customer of such circumstances and state new terms or propose alternatives.

In the event of force majeure lasting longer than two (2) months, both the Customer and Butik El have the right to cancel the agreement with immediate effect without any claim for compensation.

12. Changes to the Terms
12.1 Butik El reserves the right to make changes to these Terms at any time. All changes to these Terms will be published on the Website. Changes apply from when the Customer has accepted the Terms (in connection with a new purchase or when visiting the Website), or 30 days after Butik El has informed the Customer of the changes. Butik El, however, recommends that the Customer regularly check the Website to be aware of any changes to the Terms.
13. Invalidity
13.1 – If a competent court, authority, or arbitration board should find that any provision in these Terms is invalid or unenforceable, the provision in question and all other provisions shall be valid and enforceable to the extent permitted by applicable law. Provisions declared invalid or unenforceable will be replaced by relevant legal guidance and advice.
14. – Applicable law and dispute
14.1 – Disputes shall primarily be resolved amicably after discussion with Butik El's customer service.
14.2 – If a dispute cannot be resolved amicably with Butik El's customer service, you as a customer can contact ARN (the National Board for Consumer Disputes), which you can find more information about at www.arn.se. You can also submit a complaint directly online via the EU Commission's platform for dispute resolution, which you can find via the following link http://ec.europa.eu/consumers/odr. If you submit a complaint via this platform, your case will be automatically forwarded to the correct national responsible dispute resolution body. This dispute resolution body will then contact us and try to resolve the dispute without involving a court.
In the event of a dispute, Butik El will follow decisions from ARN or equivalent dispute resolution bodies.
14.3 – Disputes regarding the interpretation or application of these Terms shall be interpreted in accordance with Swedish law and decided according to point 14.2 above or, as a last resort, by a general court.

The only payment option at Butik EL Sverige AB is listed at the bottom of the homepage. Klarna is currently the only option.

Butik El values your personal privacy and strives to always protect your personal data in the best possible way. It is Butik El's goal to comply with all applicable laws and regulations for personal data protection at all times. This policy will help you, among other things, understand what kind of information Butik El collects and how it is used. By approving the policy on the Website in connection with a purchase or providing information, you consent to the processing of your personal data in accordance with the following.

What personal data do we process?
We will process the personal data that you provide or have provided to us or that we have collected on the Website through cookies. The data may also be used to analyze purchasing habits in order to provide you with relevant information and marketing, and to improve the Website, payment solutions, and payment processes.

 

Processing for the purpose of improving payment solutions and payment processes may include processing where your personal data, including your personal identity number, is transferred to other companies within Butik El's group and third-party providers to be included as analysis material.

Personal data may then also be cross-referenced with data from other registers, e.g., credit information registers.

Processing of personal data during payment

When purchasing on our website, your personal data – including personal identification numbers – may be processed by our payment providers for the purpose of handling payment, conducting identity verification, credit assessment (if applicable), and preventing fraud. If you choose to pay with Klarna, personal data (e.g., name, address, contact details, and personal identification number) may be transferred to Klarna AB. Klarna uses this data to determine if you can be offered invoicing, partial payment, or direct payment, and to perform necessary credit checks.

When paying via PayPal, information such as name, email address, and payment information is transferred to PayPal (Europe) S.à r.l. et Cie, S.C.A. The personal data is used to process the payment and protect against fraud. PayPal may transfer data to countries outside the EEA, but takes protective measures in accordance with GDPR.

The use of the data may involve cross-referencing with other registers, both within and outside the EU, and the transfer of your personal data to, and processing by, other companies within Butik El's group for the aforementioned purposes in accordance with applicable laws and regulations.

 

The data may also be cross-referenced or shared with authorities or our partners for, for example, printing and distribution, as well as payment intermediaries and credit companies for payment or credit information.

We use certain services that may involve transferring personal data to countries outside the EEA (European Economic Area). This includes, among others:

  • One.com (Denmark): Hosting partner that processes data within the EU. Some services may involve third-country transfers via sub-processors.

If all or part of Butik El's operations are sold or integrated with other operations, your personal data may be disclosed to our advisors, any buyer and their advisors, and further transferred to the new owner of the business.
How do we protect your personal data?
To keep the personal data we process safe, we have taken several security measures;

 

We have implemented security procedures and technical and organizational measures to protect your personal data, such as browser certification technology.

Furthermore, we have appropriate firewalls and antivirus programs to protect and prevent unauthorized access to the network.

Access to the areas where personal data is stored is restricted and employees are required to be identified for access.

Butik El also uses, among other things, SSL (Secure Socket Layer) which is a protocol for secure transfer of data via the Internet (or other networks).

 

As a customer, you need to check that SSL is not disabled in your browser settings.

To prevent unauthorized access when processing your debit or credit card number, one-way encryption is also used.

How long is my personal data stored?
If you have consented to be a registered customer/member of Butik El, your data will be stored until you unsubscribe.

 

You can unsubscribe as a customer at any time.

If you do not register as a customer/member, your data will be stored for as long as it is necessary due to legal requirements or to fulfill Butik El's obligations towards you, e.g., to fulfill delivery and warranty obligations.

In any case, your data will never be stored longer than permitted by applicable personal data legislation and accounting law.

Access, update, and correction of your personal data
According to current personal data legislation, you have the right to receive information once per calendar year, free of charge, about what personal data about you is processed, regardless of how it was collected. If you want such information, you must submit a written request to us.

 

The request must, according to current personal data legislation, be sent signed by you by mail to the address specified on the Website.

It cannot, therefore, be sent by e-mail.

Butik El wants to ensure that your personal data is accurate and up-to-date.

 

If any of the information you have provided to Butik El changes, e.g., if you change your email address, name or payment details, or if you wish to cancel your user account, please provide Butik El with accurate information by sending an email to: Butik El.
You have the right to request at any time that personal data be corrected, blocked, or deleted.

Your personal data will not be processed for direct marketing purposes if you object to such processing. You have the right to withdraw a given consent for the processing of personal data at any time. Such withdrawal may be limited to only apply to a part of the processing, for example, that which concerns direct marketing.

Delivery Terms
Order confirmation
Once we have received your order, we will promptly send you a confirmation via e-mail with information about your order.

 

Save the order confirmation to have on hand for any contact with customer service. Always check the contents of the package and ensure it matches your order confirmation.

Delivery
Orders are delivered to the door, if this can be done with your approval as a customer and by door we mean the address you specify in the order.
You specify which address you want your delivery sent to. Your home, your workplace or why not the summer cottage?
Deliveries take place during the day between 07.00-16.00 on weekdays, Monday to Friday.
On the day you have specified as the delivery day when ordering, you need to be available by phone all day.

 

The shipping company will contact you by phone when the material is at the specified address. You then need to be physically present to receive the order and sign for it.

You choose the delivery day yourself, a minimum of 3 days from the ordered material and a maximum of 30 days in advance. Deliveries are only made on weekdays, Monday to Friday.
We reserve the right to remove backordered products from the order.
Incorrect address
If you have filled in incorrect address details and we have already sent your package, we will charge a fee from SEK 200, which may be higher depending on the circumstances and the goods.
Right of Withdrawal, Return & Exchange
A 14-day right of withdrawal applies to purchases from Butik El. The customer has the right to cancel their purchase by notifying Butik El and returning the product with the enclosed return slip. The right of withdrawal does not apply to cut cables or specially manufactured products that you as a customer have specially ordered.

Complaint/Warranty
A complaint can be made if the product is broken or has hidden shipping damage.
Visible transport damage must be reported directly to us upon receipt of delivery. You as a customer must, without delay, inform Butik El what is damaged, how it is damaged, and photograph the damage. Transport damage will only be accepted as a complaint by Butik El if the report is made without delay.
A complaint is made via a Complaint Form. The form will be sent by Butik El to the customer upon request regarding a complaint. It must be filled out in its entirety and nothing should be left blank. Once the form is filled out, it must be sent to Butik El for review. You as a customer will then receive a response regarding the complaint. If the complaint is accepted, a shipping label will be sent to you so you can return the material. Once the return label and product have been sent to Butik El, a new product equivalent to the complained product will be sent to you. The new complained product will be sent via Postnord for collection at a specified location.
